Cargo Transport Terms and Conditions

Official Documentation

  1. The carrier shall apply, regardless of the taxable weight and commercial value of the cargo, the minimum and constant weight tariffs of the tables affixed to the terminals' style places.
  2. The carrier shall apply, in addition to the criteria set out in paragraph 1, a 3% transport charge on orders with a commercial value exceeding 10,000,00MT.
  3. The consignor shall declare the order by delivering to the carrier a copy of the purchase invoice of the goods to be carried, specifying, in the freight ticket, the actual identification of the goods contained in the volumes, the quantity, weight and commercial or estimated value of the volumes to be carried, their condition of storage and allowing the conference, otherwise the carrier will be excluded from any civil liability.
  4. The consignor shall provide the necessary documentation where the nature of the order or the route so requires, not responding to the carrier for retentions, seizures, fines, delays, returns or other damage resulting from the lack, insufficiency or irregularity of the required documents.
  5. The carrier reserves the right to refuse the transport of goods when, in the conference, it finds an irregularity in the item, dishonesty or omission in the provision of information related to the good to be carried.
  6. The transport of psychotropic substances is expressly prohibited.
  7. The time limit for delivery of the order to the consignee is 5 working days, but the order may be delivered 2 days after being dispatched to the carrier's shipping terminal.
  8. The addressee shall withdraw the order upon presentation of the copy of the respective cargo ticket and identity card.
  9. The consignee shall confer the integrity of the goods in the act of
    receipt of the order and in the presence of the official of
    carrier.
  1. The carrier is not liable for fraud resulting from the use of unofficial channels, information provided by third parties, purchase of tickets outside authorised means or payments made for mobile portfolios not indicated by the carrier.
  2. The carrier is not responsible for the loss or loss of order resulting from force majeure and fortuitous.
  3. The carrier shall be exempt from liability in the event of loss of undeclared cargo as provided for in these terms and
    conditions.
  4. Without prejudice to the provisions of paragraph 1, the carrier reserves the right to, on a purely exceptional, discretionary basis and without recognition of any obligation to compensate, examine each specific situation and allocate a compensation which it considers reasonable in the circumstances of the case, never exceeds the maximum amount of MT 20,000 per consignment or occurrence.
  5. The carrier shall be responsible for the loss, loss and damage of the cargo declared in accordance with these terms, provided that it is attributable to the carrier, up to the limit of its commercial value and the depreciation suffered by it, as appropriate.
  6. The consignor shall answer for the falseness, inaccuracy and inadequacy of the information provided and shall compensate the carrier for fines, seizures, losses, damages, delays, complaints or costs resulting from them.
  7. The consignor shall be responsible for the packaging of the order and shall ensure its suitability to the nature, weight, fragility, size, route and normal conditions of road transport, so that fragile, perishable, liquid, electronic or sensitive goods must be identified and packed in a reinforced manner.
  8. A transportadora não responde pelo dano ou extravio de encomendas que ocorra por facto imputável ao expedidor, por vício da coisa transportada e por embalagem imprópria.
  9. A transportadora fica isenta de responsabilidade em caso de extravio, deterioração, perda de bens cujo valor comercial não tenha sido declarado antes da expedição, ou que não tenham sido conferidos no acto de expedição por causa imputável ao expedidor.
  10. A transportadora não se responsabiliza por reclamações relativas à falta, perda ou dano de encomenda que não tenha sido conferida pelo destinatário no acto do levantamento, no respectivo local, e na presença do funcionário responsável pela sua entrega.
  1. O cliente deverá submeter a sua reclamação por escrito no prazo de até 72 horas contadas da data da ocorrência, de modo a permitir a verificação tempestiva dos factos e de demais elementos necessários à verificação e tramitação da reclamação pela transportadora.
  2. O destinatário da encomenda expedida deve submeter uma reclamação decorridas 48 horas contadas a partir da data prevista para a recepção da encomenda, caso não ocorra o seu
    recebimento.
  3. The carrier shall review and respond to complaints submitted within 15 days of the date of submission to its terminals.
  4. Claims that have been proven false, fraudulent, or that have been examined with adulterated documents may be rejected and communicated to the competent authorities, without prejudice to the carrier's right to compensation for the damage caused.
  1. The Parties shall, in addition to these terms and conditions, be bound by other relevant legislation governing road transport.
  2. Conflicts arising from the application or interpretation of these terms and conditions will be settled by the Maputo City Judicial Court when it occurs throughout the South Zone and by the Beira City Judicial Court when it occurs in the central and northern zone of the country.
  3. The parties agree that the costs inherent in the coercive recovery of debt arising from the default of these terms and conditions will be charged to the default party.
  4. The carrier reserves the prerogative to update these Terms and Conditions for legal, operational, tariff, technological or security adequacy, and must make available the current version on its official channels. The applicable version shall, as a rule, be that in force on the date of purchase of the ticket or hiring of the service.
  5. O expedidor e destinatário autorizam o tratamento dos dados pessoais estritamente necessários à emissão de bilhetes, execução do transporte, segurança, facturação, atendimento, reclamações, cumprimento de obrigações legais, prevenção de fraude e comunicação com autoridades competentes, nos termos da legislação aplicável.
  6. These Terms and Conditions, as well as their content, structure, wording, marks, distinctive signs, graphic elements and other associated materials, are the property of the carrier, and its copy, reproduction, distribution, publication or use, in whole or in part, by third parties, without prior and express authorization of the carrier.
